PURPOSE OF THE APPLICATION:
At its Hearing on April 6, 2016 the Committee adjourned this application for
recirculation. The Owner has revised its plans and now wants to proceed with the
application to demolish the existing convenience store building, gas pumps and car
wash and construct a new convenience store building with a coffee shop and a drive-
through which will be located on the south side of the property. The application
indicates that existing gas pumps will be removed and replaced with 8 new gas pumps
and the site will contain 20 parking spaces.
In order to proceed, The Owner requires the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
a) To permit a reduced landscaped area width of 2.1 metres, for the area located
between two private approaches along Trim Road whereas the By-law requires a
landscaped area width of 3 metres.
b) To permit a reduced building setback of 6.3 metres from the property line
abutting Trim Road for the gas bar canopy whereas the By-law requires a
minimum front yard and corner side yard setback of 7.5 metres.
c) To permit a refuse collection area to be located 6.7 metres from a lot line abutting
a public street whereas the By-law requires a refuse collection area within a
parking lot to be located at least 9 metres from a lot line abutting a public street
(Taylor Creek Drive).
d) To permit a gas bar to be 568.5 square metres in area whereas the By-law
permits a gas bar to be a maximum of 300 square metres in an IL zone.
THE APPLICATION indicates that the Property is the subject of an ongoing Site
Plan Control Application (D07-12-12-0120) application under the Planning Act.
