PURPOSE OF THE APPLICATION:
At its Hearing of November 18, 2015, the Committee adjourned this application at the
request of the Agent for the Owner to allow the Site Plan process to be completed. The
Owner now wants to proceed with this application to construct four retail buildings and a
restaurant along the northerly boundary of the property fronting on Ogilvie Road.
In order to proceed, The Owner requires the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
a) To permit a reduced landscaped buffer width of 0.8 metres along the northerly
boundary of the property for a parking lot containing 100 or more parking spaces
whereas the By-law requires a minimum landscaped buffer width of 3 metres for
a parking lot containing 100 or more parking spaces.
b) To permit a reduced aisle width of 6.2 metres for an aisle providing access to 90
degree angle parking spaces in a parking lot whereas the By-law requires a
minimum drive aisle width of 6.7 metres for 90 degree angle parking spaces in a
c) To permit a refuse collection area to be located 5.84 metres from a lot line
abutting a public street whereas the By-law requires a refuse collection area
contained within a parking lot to be located at least 9 metres from a lot line
abutting a public street.
d) To permit a refuse collection area contained within a parking lot to be screened
by decorative grasses whereas the By-law requires that all refuse collection
areas contained within a parking lot be screened from view by an opaque screen
with a minimum height of at least 2 metres.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
