Passed    Motion To: WHEREAS Report ACS2013-PAI-PGM-0033 recommends approval of zoning amendments to address interpretation and implementation issues and to correct errors in Zoning By-law 2008-250; and WHEREAS the report includes a recommendation that will prohibit secondary dwelling units in new duplexes; and WHEREAS the City has reached agreement regarding resolution of an appeal to the Ontario Municipal Board regarding construction of a new duplex with a secondary dwelling unit; and WHEREAS the appellant needs further time to obtain a building permit prior to the use being prohibited as a result of the report recommendation; and WHEREAS it is recommended to apply an exception to the lands to extend the period of time a secondary dwelling unit in a new duplex is permitted by the Zoning By-law; THEREFORE BE IT RESOLVED that Council: 1. Amend Document 1 of the report by adding the MAP F, attached in this motion; and 2. Amend Document 4 of the report by adding the following item: Item: 4. 466 – 470 Guy Street (Ward 13) Objective of amendment: The City has reached agreement regarding resolution of an appeal before the Ontario Municipal Board regarding construction of a new duplex with a secondary dwelling unit. The appellant needs further time to obtain a building permit prior to the use being prohibited as a result of recommendations in this report concerning permissions for secondary dwelling units in new duplexes. Proposed Amendment: Amend the Zone Map of By-law 2008-250 from R3A to R3A[XXXX] with a new Urban Exception [XXXX] as follows and as shown in document 1, Map F: 466 – 470 Guy Street Amend Section 239 by adding a new Urban Exception as follows: Column II Applicable Zones: R3A[XXXX] Column III Additional Land Uses Permitted: duplex with secondary dwelling unit Column V Provisions: - despite the provisions of Section 133, this by-law does not apply to prevent the issuance of a building permit for a duplex with secondary dwelling unit for which an application for a building permit has been received on or before July 17, 2013 - required number of parking spaces for a duplex with secondary dwelling unit that is permitted through the provisions of this exception: 3 - a parking space for a secondary dwelling unit in a new duplex may be located in a driveway that passes through a front yard to a garage, carport or other parking space, and may be in tandem in the driveway BE IT FURTHER RESOLVED THAT the Rules of Procedure be waived to permit a by-law, implementing the above, to be listed on the Council agenda. BE IT FURTHER RESOLVED THAT pursuant to the Planning Act, subsection 34(17) no further notice be given.
