Passed    Motion To: WHEREAS Report ACS2013-PAI-PGM-0142 recommends approval of a zoning amendment on the properties known municipally as 233 Armstrong Street and 3 Hamilton Avenue; and WHEREAS Planning Committee at its meeting of June 25, 2013 refused the recommendation of the Report; and, WHEREAS an existing use on the properties is seeking to expand within the existing building located on the subject property, and such expansion was to be permitted for zoning purposes through the Report; and, WHEREAS staff is in support of a rezoning to permit the existing use and not requiring parking for non-residential uses to facilitate the expansion of the existing use; THEREFORE BE IT RESOLVED that Council approve: 1. That the Report be amended as follows: a) By replacing the existing recommendation with the following: “That Planning Committee recommend Council approve an amendment to Zoning By-law 2008-250 to change the zoning of 233 Armstrong Street and 3 Hamilton Avenue from Light Industrial, Subzone 8, Exception 104 with a floor space index of 2.0 and a maximum height of 13.5 m (IL8[104] F(2.0) H(13.5)) to Mixed-Use Centre Subzone 16 with an exception (MC16[XXXX]), as shown in Document 1 and Detailed in Document 2” b) By replacing the text in Document 2 with the following: “1. Rezone the lands shown in Document 1 from IL8[104] F(2.0) H(13.5) to MC16[XXXX].” 2. Add a new exception, MC16[XXXX], to Section 239 – Urban Exceptions with provisions similar in effect to the following: i) In Column III the text “- light industrial use limited to a brewery” ii) In Column V the text “- no parking is required for non-residential uses” 2. That the Rules of Procedure be waived to permit a by-law implementing the recommendation of the Report, as amended by this motion, to be listed on the Council Agenda, BE IT FURTHER RESOLVED THAT pursuant to the Planning Act, subsection 34(17) no further notice be given.
