Failed    Motion To: WHEREAS Report ACS2013-PAI-PGM-0046 recommends approval of a zoning amendment on the property known municipally as 5901 and 5911 Meadowglen Drive; and WHEREAS it has been deemed advisable to amend the report to make certain changes to the recommended R4M[XXXX]-h zoning provisions to prohibit the use “apartment dwelling, low-rise”; and WHEREAS Planning Committee refused the recommendation of the report and carried an amended recommendation as follows: That the proposed zoning maintains the Residential First Density Subzone W – Holding (R1W-h) zoning for the property fronting on La Chapelle Street; and WHEREAS the amended recommendation does not give the authority to pass a by-law amending the zoning on the remainder of the subject property; THEREFORE BE IT RESOLVED that Council further approve: 1. That the following changes be made to the staff report: Document 6, Details of Recommended Zoning be amended by replacing the wording under the heading “In column IV, prohibited uses, add:” with the following: - apartment dwelling, low-rise - all other uses until such time as the holding symbol is removed; and 2. An amendment to Zoning By-law 2008-250 to change the zoning of part of 5901 and 5911 Meadowglen Drive from Residential First Density Subzone W – Holding (R1W-h) to Residential Fourth Density Subzone M, Exception – Holding (R4M[XXXX]-h), as it applies to the remainder of the property not fronting on La Chapelle Street, in accordance with Planning Committee’s amended recommendation. 3. That the Rules of Procedure be waived to permit a by-law, implementing the above, to be listed on the Council Agenda. BE IT FURTHER RESOLVED THAT pursuant to the Planning Act, subsection 34(17) no further notice be given.
